o Google to Pay Record $22.5 Million to Settle FTC Charges

Washington, DC -- Google will pay a record $22.5 million civil penalty to settle Federal Trade Commission (FTC) charges that it lied to users of Apple's Safari Internet browser when it told them it would not place tracking "cookies" or serve targeted ads to those users, the FTC said on Thursday. The actions violating an earlier privacy settlement between the Mountain View-based company and the FTC, struck last October. In addition to the penalty, Google also must disable all the tracking cookies it had said it would not place on consumers' computers. "The record-setting penalty in this matter sends a clear message to all companies under an FTC privacy order," said Jon Leibowitz, chairman of the FTC. "No matter how big or small, all companies must abide by FTC orders against them and keep their privacy promises to consumers, or they will end up paying many times what it would have cost to comply in the first place." According to the FTC's complaint, Google specifically told Safari users that the browser was set by default to block third-party cookies, and would continue to do so as long as they didn't change their settings.

o John Schappert Resigns as COO of San Francisco-Based Zynga

San Francisco -- John Schappert has resigned as the COO of San Francisco-based social games developer Zynga, the company announced in a regulatory filing. Zynga, which said that Schappert "leaves as a friend of the company," has not yet named a successor. The move comes less than a month after Zynga -- the publisher of such popular titles as FarmVille and Words With Friends -- shook up its management structure following poor second-quarter results, removing some of Schappert's responsibilities in the area of game development. Zynga had hired Schappert away from rival Electronic Arts early last year.

o Digia to Acquire Qt Software Business from Nokia

Santa Clara, Calif. -- Digia, the Finland-based IT services provider with U.S. headquarters in Santa Clara, said on Thursday it will acquire the Qt software business from Nokia. Financial terms of the deal were not disclosed. The company already had acquired Qt Commercial's licensing business from Nokia in 2011. With the latest move, up to 125 Qt employees from Nokia will transfer to Digia, mostly based in Norway and Germany. Digia said the acquisition will significantly strengthen its product business and support its international growth plans. Qt's software has been used by over 450,000 developers to build mobile apps.

o Redwood Shores-Based ESO Fund Closes Inaugural $25 Million Fund

Redwood Shores, Calif. -- The Redwood Shores-based Employee Stock Option (ESO) Fund said on Thursday it has closed its debut fund at $25 million. The firm will lend money to current and departing employees of venture-backed companies to exercise their stock options. "We estimate that each year employees of private companies forfeit approximately $500 million in future earnings in the form of stock options that are not exercised," said Stephen Roberts, the fund's managing general partner. "We can help anyone from the receptionist up to the CEO capture some of that value without them having to take a lot of risk."

o U.S. Retail E-Commerce Spending Jumps 15% in Second Quarter

Reston, Va. -- Online retail spending reached $43.2 billion in the U.S. during the second quarter, up 15% from the same period a year ago, according to new figures from comScore. It marks the 11th straight quarter of year-over-year growth and seventh straight quarter of double-digit growth. "While the second quarter's 15% growth rate couldn't quite match the especially high growth rate from the first quarter, it was nevertheless almost four times higher than the growth in overall consumer spending, a sign of continued strength in the e-commerce channel," said Gian Fulgoni, the chairman of comScore. “That said, although e-commerce remains strong, we are taking a cautious view of the second half of the year in light of some renewed signs of economic uncertainty and a stubbornly high unemployment rate."
