o Google Settles Trademark Dispute with Rosetta Stone

Mountain View, Calif. -- Following three years of on-again, off-again litigation between the companies, Rosetta Stone, the large provider of language learning software and online services, said it has agreed to settle its trademark infringement lawsuit with Mountain View-based search giant Google. Rosetta Stone initially filed the suit in 2009, seeking to prevent the Silicon Valley company from letting third parties -- including counterfeiters -- use Rosetta Stone's trademarks in online ads. The suit was dismissed two years ago by a federal court in Virginia, but reinstated earlier this year by the U.S. Court of Appeals. Now, the two companies have vowed to join forces to combat online ads for counterfeit goods and prevent the misuse and abuse of trademarks on the Internet. "At the end of the day, both companies would rather cooperate than litigate, and we believe this agreement is an important step toward eliminating piracy and trademark abuse on the Internet," the two companies said in a statement.

o Menlo Park-Based IVP Leads $35 Million Round in MindBody

Menlo Park, Calif. -- Institutional Venture Partners (IVP), the Menlo Park-based venture capital firm focused on later-stage technology companies, said on Thursday it has led a new $35 million round of funding in San Luis Obispo-based MindBody, a provider of online business management software to the beauty, health and wellness industry. Previous backers Catalyst Investors and Bessemer Venture Partners also participated in the round, which the company will use to accelerate its international expansion and product development efforts. Founded in 2001, MindBody currently serves more than 21,000 health, wellness and beauty-based businesses in 80 countries. The company's web-based business management software helps businesses manage all aspects of their operations, including web scheduling, staff management, point of sale, payment processing, automated marketing and e-commerce. Norm Fogelsong, a general partner of IVP, has join the company's board of directors.

o Billionaire Icahn Buys 10% of Netflix; May Push for Possible Sale

Los Gatos, Calif. -- Shares of Los Gatos-based Netflix fell slightly on Thursday, a day after the stock posted its biggest jump since January on news that billionaire financier Carl Icahn had acquired a 10% stake in the company. Icahn disclosed that he acquired 5.54 million shares of Netflix for $168.9 million. According to a filing with the Securities and Exchange Commission (SEC), Icahn believes Netflix's shares are "undervalued" due to the company's "dominant market position and international growth prospects," and that it's ripe for an acquisition. "Netflix may hold significant strategic value for a variety of significantly larger companies that are engaging in more direct competition with one another due to the evolution of the internet, mobile, and traditional industry," according to a the filing. Shares of Netflix rose nearly 19% on Wednesday.

o Report: U.S. Semiconductor Employment Reaches Nearly 250,000

Washington, DC -- The U.S. semiconductor industry now employs nearly a quarter million workers and added manufacturing jobs three times faster than the rest of the U.S. economy over the past year, according to the Semiconductor Industry Association (SIA). Citing data from the Bureau of Labor Statistics, the SIA said U.S. semiconductor employment is now estimated at 244,800. Manufacturing jobs in the industry grew 3.7% over the prior year. Brian Toohey, president and CEO of the SIA, called the figures "an encouraging sign for our industry."

o Hayward-Based ACD Raises $12 Million in Second Round

Hayward, Calif. -- Advanced Cell Diagnostics (ACD), a Hayward-based molecular pathology startup developing cell- and tissue-based diagnostic tests for personalized medicine, said on Thursday it has raised $12 million in its second round of funding. New Leaf Venture Partners and previous backer Morningside Ventures participated in the round, which the company will use to support the commercial expansion of its RNAscope-based products and services into the life science research market and accelerate their entry into the clinical diagnostics market. "We now have the resources to take ACD to the next level," said Yuling Luo, the founder, president and CEO of ACD.

o Federal IT Spending Requests Drop Nearly $1B in Fiscal 2013 Budget

McLean, Va. -- In the face of looming sequestration, federal IT spending requests have dropped nearly $1 billion over last year's levels in the 2013 budget request. According to market intelligence firm immixGroup, IT spending requests total approximately $78.9 billion, down from last year’s $79.7 billion, though the continuing resolution and potential sequestration most likely will lower actual IT spend to between $73-$74 billion. "Sequestration will cap discretionary spending levels between 2013 and 2021, and will require overall spending cuts of $1.2 trillion," said Stephanie Sullivan, a civilian market intelligence consultant with immixGroup. "Some $38.5 billion will be cut in FY13, of which $8.92 billion will come from contract dollars. Large programs and contractor spending will most likely be affected as IT development shifts towards incremental progress and agile development practices to squeeze more value from limited dollars."
