The deal is expected to close in the next few months. Nest launched its popular Internet-connected thermostat in 2011, and recently launched a similar smoke and carbon monoxide alarm. Riverwood Capital and SAP Ventures co-led the round, which also includes participation from new investors Morgan Stanley Expansion Capital and Greenspring Associates, along with previous backers Lightspeed Venture Partners, Khosla Ventures and Battery Ventures. The company, which now has now raised $172.2 million since its inception, will use the latest proceeds to expand globally, bolster research and development, grow its service delivery capabilities and augment its sales, marketing and support teams. Nutanix is the developer of a virtual computing platform that delivers web-scale IT infrastructure to clients such as eBay, McKesson, Toyota, Orange Business Services and Hyundai Hysco. "Adoption of web-scale computing… has grown explosively over the last two years, yet we've only scratched the surface of this $100 billion hybrid computing market," said CEO Dheeraj Pandey. http://www.nutanix.com http://www.nutanix.com/nutanix-announces-101m-series-d-funding-round-at-approximate-1b-valuation _____________________________________________ o Appeals Court Strikes Down Key Provision of "Net Neutrality" Washington, DC -- In what could be a major blow to the concept of net neutrality, a federal appeals court on Tuesday overturned a Federal Communications Commission (FCC) rule essentially aimed at keeping Internet service providers from being able to charge content companies to speed the rate of their downloads. The court ruled the FCC doesn't have the authority to prevent the practice of "discrimination" because it hasn't classified broadband Internet as a "common-carrier" service, like traditional phone service. "Because the Commission has failed to establish that the anti-discrimination and anti-blocking rules do not impose per se common carrier obligations, we vacate those portions of the Open Internet Order," the court wrote. Verizon had challenged the net neutrality rule in 2011. http://www.pcworld.com/article/2087441/appeals-court-strikes-down-fccs-net-neutrality-rules.html http://consumerist.com/2014/01/14/appeals-court-strikes-down-net-neutrality-rules/ http://online.wsj.com/news/articles/SB10001424052702304049704579320500441593462?mod=djemalertTECH _____________________________________________ o Fremont-Based Exar Acquires Sunnyvale-Based Stretch Fremont, Calif. -- Exar, a Fremont-based developer of analog mixed-signal and data management technology, said on Tuesday it has acquired Sunnyvale-based Stretch, a maker of software configurable processors for the video surveillance market. Financial terms of the deal were not disclosed. Exar said the acquisition will give it the technology needed to deliver a high-definition product for both the digital and analog transmission of data from the camera to the DVR or NVR in surveillance applications. "Coupled with our high-performance analog products, we are now positioned to deliver best in class solutions for a wide variety of camera, transmission and recording technologies in the high growth video surveillance market," said Louis DiNardo, the president and CEO of Exar. Craig Lytle, the president and CEO of Stretch, will become Exar's senior vice president of system products. http://www.exar.com/ http://www.stretchinc.com/ http://ir.exar.com/company-news/detail/514/exar-acquires-stretch-incorporated _____________________________________________ o Foster City-Based E2open to Raise Up to $82.5 Million in Offering Foster City, Calif. -- E2open, a Foster City-based developer of software designed to let clients procure, sell and distribute products more efficiently across global trading networks, said on Tuesday it plans to raise up to $86.25 million in a follow-on offering. Forty-one percent of developers targeting Android said their typical app is finished in one month or less, compared with 36% for iOS and 34% for Windows Phone. On all platforms, the largest part of the time is spent on testing and debugging, except for Firefox and Tizen, where coding takes more time. Android, which surpassed iOS in 2011 as the top development target for smartphones, is now also targeted by more developers than any other operating system for tablets. Eighty-four percent of those targeting tablets target Android, compared with 62% targeting iOS and 52% targeting Windows.
