o Carl Icahn Ends Push for Apple Stock Buyback

Cupertino, Calif. -- Activist investor Carl Icahn has backed off of his push for Cupertino-based Apple to buy back a massive amount of its stock. The move comes after Institutional Shareholder Services (ISS) on Sunday recommended that shareholders vote against Icahn's proposal, which sought an additional $50 billion in buybacks. That followed news last week from Apple CEO Tim Cook that the company had bought back $14 million in stock during the two weeks after its fourth-quarter earnings report. "In light of these actions, and ISS's recommendation, we see no reason to persist with our non-binding proposal, especially when the company is already so close to fulfilling our requested repurchase target," Icahn wrote in a letter to shareholders. The full letter is available at the link below.

o Battery Ventures Acquires Controlling Stake in San Jose's Data Physics

Menlo Park, Calif. -- Battery Ventures, the venture capital firm with West Coast operations based in Menlo Park, said it has acquired a controlling stake in San Jose-based Data Physics Corp., a maker of test-and-measurement systems for noise and vibration applications. Financial terms of the deal, which will allow Data Physics to pursue growth organically and through acquisitions, were not disclosed. In conjunction, Battery has installed Louis Pace, a former executive in residence at the firm, as the company's new CEO. Pace earlier served as the COO of HallStar and vice president of business development at Belden. Data Physics was co-founded in 1984 by Sri Welaratna and fellow Hewlett-Packard alumnus Dave Snyder. The two built the company into a major provider of digital signal processing technology to help companies perform acoustic tests, structural tests, rotating machinery diagnostics and vibration characteristics analysis.
