o Mountain View-Based Google to Face Antitrust Charges in Europe

Mountain View, Calif. -- After avoiding formal charges in the U.S., Mountain View-based Google now will face a legal battle in Europe after the European Commission on Wednesday charged the Internet giant with systematically favoring its own comparison shopping product in search results. "Such conduct infringes EU antitrust rules because it stifles competition and harms consumers," the Commission said in a statement. "The Commission is concerned that users do not necessarily see the most relevant results in response to queries -- this is to the detriment of consumers, and stifles innovation." The Commission also has opened a separate antitrust investigation into the company's conduct regarding its Android mobile operating system. Specifically, the investigation will focus on whether Google has breached EU antitrust rules by hindering the development and market access of rival mobile operating systems, applications and services. The case is expected to be the largest antitrust battle in Europe since the Commission charged Microsoft a decade ago.

o San Jose-Based RetailNext Secures $125 Million in New Funding

San Jose, Calif. -- RetailNext, a San Jose-based developer of in-store retail analytics, said on Wednesday it has raised an additional $125 million in growth capital, led by Activant Capital Group. Previous backers August Capital, StarVest Partners, Nokia Growth Partners, Commerce Ventures, American Express, Pereg Ventures and Qualcomm Ventures also participated, along with new investor Siguler Guff & Company. Activant's founder, Steve Sarracino, has joined the company's board of directors. RetailNext measures the behavior of shoppers by collecting data from tens of thousands of sensors in retail stores. The company plans to use the proceeds to accelerate growth in new markets' strengthen its presence in North America, Europe and Asia; and pursue possible acquisitions.

o S.F.-Based Docker Secures $95 Million in Fourth Round

San Francisco -- Docker, the San Francisco-based organization behind the open platform for distributed applications, said it has raised $95 million in its fourth round, led by Insight Venture Partners. New investors Coatue, Goldman Sachs and Northern Trust and previous backers Benchmark, Greylock Partners, Sequoia Capital, Trinity Ventures and Jerry Yang's AME Cloud Ventures also participated. Docker said the financing will enable deeper integration with partners such as AWS, IBM and Microsoft, who have made product investments in support of the company's open source technology. It will also fuel new platform capabilities. "We think [clients] are still looking for a platform that helps them build and ship applications in a truly standardized way, without lock-in or unwanted bundled features," said founder and CTO Solomon Hykes. "That is what we set out to build, and we are not yet content with what we have achieved so far. We are getting a clear message from the market that they like what we are building, and we plan to keep building it. The financing enables us to deliver on that promise."

San Francisco -- Sprig, the San Francisco-based developer of an on-demand meal service that lets smartphone users choose from three healthy meal options to be delivered in 15 minutes, said on Wednesday it has landed $45 million in its second round of funding. Social Capital led the round, which also included participation from previous investor Greylock Partners. With the funding, the company said it will expand its service from San Francisco to cities across the country, beginning with the remainder of the Bay Area and Chicago. Ted Maidenberg of Social Capital will join the company's board of directors.

o Mountain View-Based Skyport Systems Lands $30M in Second Round

Mountain View, Calif. -- Skyport Systems, a Mountain View-based developer of security-focused IT infrastructure, said on Wednesday it has landed $30 million in its second round of funding, led by Index Ventures. Intel Capital and previous investor Sutter Hill Ventures also took part in the round, which increases the company's total funding to $37 million. Skyport said its approach tightly integrates compute, security, virtualization and policy management. "Network security models today have been compromised, due to reliance on perimeter security and static network policies that fail to address the current threat landscape," said CEO Stefan Dyckerhoff, who also is managing director at Sutter Hill Ventures. "Skyport will use this funding to deliver a fundamentally new approach and solution to protecting business' most mission-critical IT control infrastructure and applications." San Francisco -- 99designs, the San Francisco-based operator of an online marketplace for logo and graphic design, said on Wednesday it has raised $10 million in its second round of funding, led by Recruit Strategic Partners. Accel, which led the company's first round in 2011, also participated in the round, which the company will use for international expansion, particularly in Asia. Patrick Llewellyn, the CEO of 99designs, said that a key to the company's expansion plans was partnering with Recruit, a major player in the Japanese information services market. "We knew that we would need the right partner to enter Japan and expand our footprint in the broader Asia market," said Llewellyn. "The fit with our business is perfect." Accel partner Rob Solomon, the former president and COO of Groupon, has joined the company's board of directors.

o NEA Raises $3.1 Billion for Two New Funds, Promotes Scott Sandell

Menlo Park, Calif. -- New Enterprise Associates (NEA), the venture capital firm with West Coast operations in Menlo Park, said on Wednesday it has raised $3.1 billion for a pair of new investment funds, including $2.8 billion for its 15th core fund, to be known as NEA 15. It marks the firm's fourth consecutive fund of at least $2.5 billion. Another $350 million will go to the NEA 15 Opportunity Fund, a co-investment vehicle aimed at later-stage financings. The new funds increase the firm's cumulative committed capital to nearly $17 billion. In conjunction with the news, NEA has named Scott Sandell as managing general partner alongside Peter Barris, who had held the title independently for the past seven funds. Since joining NEA in 1996, Sandell -- who is based in Menlo Park -- has led investments in companies such as Bloom Energy, Data Domain, Fusion-io, Spreadtrum Communications, Tableau Software, WebEx and Workday. He is head of the firm's technology practice and leads NEA's investing activities in China.
